Right of withdrawal: the consumer's statutory right to rescind the distance contract within the cooling-off period.
-
Entrepreneur: Wallsharks, the user of these general terms and conditions.

Article 3 – Applicability
These general terms and conditions apply to every offer from Wallsharks and to every agreement concluded with Wallsharks, insofar as not explicitly and in writing deviated from.
The general terms and conditions are made available before the conclusion of an agreement in such a way that the consumer can save them on a durable medium.
Provisions that limit the statutory rights of a consumer are not applied insofar as this is not permitted by law.
If a provision of these general terms and conditions proves to be void or voidable, the remaining provisions shall remain in effect. The parties will replace the relevant provision with a legally valid provision that corresponds as closely as possible to the intention of the original provision.
Article 4 – The offer
Wallsharks describes products and services as completely and accurately as possible. Images are intended to represent the product as accurately as possible. With art, color, structure, gloss, material behavior, and the display on different screens may deviate to a limited extent from reality.
Obvious mistakes or obvious errors in an offer do not bind Wallsharks.
With each offer, insofar as legally required, it is clearly stated what the price including VAT is, which shipping costs apply, how the agreement is concluded, which payment methods are available, and whether the right of withdrawal applies.
When a product is specifically made or adapted for the consumer and the statutory right of withdrawal is therefore excluded, this is clearly stated before the conclusion of the agreement.
Article 5 – The agreement
The agreement is concluded when the consumer accepts the offer and complies with the conditions set out therein.
After an electronic order, the consumer receives an electronic confirmation of the order as soon as possible.
Wallsharks may refuse an order when there is a justified reason for doing so, within the limits of the law, for example when a product is demonstrably unavailable or there is an obvious price or entry error.
If an ordered product is unexpectedly unavailable, Wallsharks will inform the consumer as soon as possible, and if no suitable solution can be agreed upon, the paid amount will be refunded.
Article 6 – Right of withdrawal and returns
For standard products sold online to consumers, the statutory right of withdrawal applies. The consumer may rescind the agreement without providing a reason within 14 days from the day after they, or a third party designated by them, have received the product. In the case of an order for multiple products, the period generally begins to run after the last product has been received.
The consumer does not have to wait to report the withdrawal until the product has been delivered. Withdrawal can be reported via support@wallsharks.com or via an online withdrawal function offered by Wallsharks. A notification of withdrawal may not be made dependent on prior consent from Wallsharks.
After the withdrawal, the product must be returned within 14 days. The consumer is responsible for being able to demonstrate that the product was returned in a timely manner, for example with a proof of shipment.
To ensure the return process and the protection of artworks go as smoothly as possible, Wallsharks asks the consumer to contact them before shipping for return instructions and the correct return address. This is strictly a practical return procedure and does not limit the statutory right of withdrawal.
The consumer must handle the product with care during the cooling-off period and may only unpack or use it insofar as is necessary to assess the nature, characteristics, and functioning thereof, as one would be allowed to do in a store.
Upon return, the product must be sent back complete, including all supplied components, accessories, certificates, luxury packaging, documentation, and other items belonging to the product.
For artworks, luxury boxes, and other fragile products, the consumer must pack the product carefully and securely. If the original shipping packaging is still available, it must be used where reasonably possible. If a product is returned without adequate protection and is damaged as a result, Wallsharks may charge for the resulting reduction in value.
The absence of the original packaging does not automatically lead to the forfeiture of the statutory right of withdrawal. However, damage or reduction in value resulting from the lack of suitable packaging or careless handling may be for the account of the consumer, insofar as the law permits.
The consumer bears the direct costs of the return shipment when exercising the statutory right of withdrawal, unless Wallsharks has indicated in advance that these costs are to be borne by them or if there is a wrong, damaged, or defective product for which Wallsharks is responsible.
The consumer remains responsible for the product until Wallsharks has received the return. Wallsharks therefore advises using a suitable, traceable, and, if reasonably available, insured return shipment for valuable artworks.
If a product has been used or damaged during the cooling-off period beyond what is necessary to assess its properties, Wallsharks may deduct the reduction in value from the amount to be refunded, provided the consumer was correctly informed about the right of withdrawal before the purchase.
For products made or adapted according to the express specifications of the consumer, the right of withdrawal only applies when the statutory exception does not apply. Insofar as a custom-made product actually falls under the statutory exception, this is clearly communicated to the consumer before the order.
Standard products, including regular artworks and standard formats chosen from a pre-offered assortment, are not considered custom-made simply because they are produced after ordering. A standard choice from offered options does not therefore automatically remove the statutory right of withdrawal.
Article 7 – Costs and reimbursement in case of withdrawal
In the event of a valid withdrawal, Wallsharks will refund all payments received from the consumer, including the costs of standard delivery. If the consumer has chosen a more expensive shipping method, only the amount of the cheapest standard delivery will be refunded.
Wallsharks will refund using the same payment method used for the original transaction, unless the consumer explicitly agrees to another method.
Wallsharks may withhold the refund until the product has been received or until the consumer has demonstrated that the product has been returned, whichever comes first.
The refund will take place within 14 days after the day on which the consumer reported the withdrawal, taking into account the aforementioned possibility of suspending the refund until receipt or proof of shipment.
In the event of a partial return of an order, the original shipping costs will not be refunded insofar as the law does not dictate otherwise.
When there is a reduction in value due to handling beyond what is necessary to assess the product, Wallsharks may deduct the provable reduction in value from the amount to be refunded.
Article 8 – Exclusion of the right of withdrawal
The statutory right of withdrawal can only be excluded in cases permitted by law and when the consumer has been clearly informed about that exclusion before the conclusion of the agreement.
This may include, but is not limited to:
-
Products manufactured according to the consumer's specifications or that are clearly personal in nature, insofar as they fall under the statutory exception.
-
Products for which the right of withdrawal does not apply based on another statutory exception.
-
Other statutory exceptions that apply at the time of the agreement.
Wallsharks will not apply an exclusion of the right of withdrawal more broadly than legally permitted.
Article 9 – Price and payment
All consumer prices listed on the website include VAT unless explicitly stated otherwise.
Shipping costs and any other additional costs are clearly stated before the conclusion of the agreement.
Payment can be made via the payment methods made available during checkout. Wallsharks may use external payment service providers.
Obvious price and entry errors do not bind Wallsharks, provided it is a mistake recognizable to the consumer.
Article 10 – Conformity, warranty and damage
Wallsharks guarantees that products comply with the agreement, the specifications in the offer, and the reasonable expectations that the consumer may have.
The statutory warranty and the statutory rights of consumers remain fully applicable. Any additional commercial warranty does not limit these statutory rights.
A defect must be reported to Wallsharks as soon as possible after discovery. The statutory rights of the consumer are not limited by a short reporting period.
If a product is delivered damaged, incorrect, or defective, Wallsharks requests the consumer to contact them as soon as possible and, if possible, to provide photos of the product and the packaging. This assists in processing but is not a condition for exercising statutory rights.
When a complaint is well-founded, Wallsharks will ensure an appropriate solution within the statutory framework, such as repair, replacement, or refund.
Article 11 – Delivery and risk
Wallsharks delivers to the address provided by the consumer.
Wallsharks strives to deliver orders within the indicated period. If no other period has been agreed upon, the statutory maximum delivery period applies.
When delivery is permanently impossible or unreasonably delayed, the consumer has the associated statutory rights, including, where applicable, the right to rescind the agreement.
In the case of a sale to a consumer, the risk of damage or loss transfers to the consumer as soon as the product has been delivered to them or to a third party designated in advance, unless the consumer has chosen a carrier themselves that was not offered by Wallsharks.
For shipping, Wallsharks may use Sendcloud and various carriers. Sendcloud facilitates the shipping process; the actual delivery may be carried out by a carrier.
Article 12 – Business orders
Orders by companies, legal entities, or persons acting in the exercise of their profession or business are classified as business orders.
The statutory consumer right to a cooling-off period and withdrawal does not automatically apply to business orders. For business customers, the agreements from the quotation, order confirmation, and/or agreement apply.
For business projects, art advice, delivery, and professional installation, additional agreements may be made regarding planning, payment, delivery, installation, liability, and cancellation.
Article 13 – Complaints procedure
Complaints can be reported via support@wallsharks.com. Describe the complaint clearly and, if relevant, mention the order number.
Wallsharks attempts to provide a substantive response to complaints within 14 days of receipt. If more time is required, the customer will receive an acknowledgment of receipt within that period with an indication of the further processing.
Wallsharks is affiliated with WebwinkelKeur. If a complaint cannot be resolved by mutual agreement after direct contact, the consumer may – insofar as the applicable conditions of WebwinkelKeur permit – use the mediation or dispute resolution procedure available there.
The former European ODR platform is no longer available and therefore is not part of this complaints procedure.
Article 14 – Liability
Wallsharks is not liable for damage resulting from improper or inexpert use of a product, insofar as this is legally permitted.
For consumers, statutory limitations of liability do not detract from mandatory consumer rights.
For business customers, liability may be further limited, insofar as legally permitted, in a quotation or agreement.
Article 15 – Disputes and applicable law
Agreements between Wallsharks and consumers are subject to Dutch law, with due observance of the mandatory protection enjoyed by the consumer under the law of the country where they reside.
Disputes shall be submitted to the competent court in accordance with the statutory rules.
The Vienna Sales Convention is not applicable.
Article 16 – Final Provisions
Wallsharks may amend these general terms and conditions when there is a reasonable cause to do so. The most recent version will be published on the website.
Amendments do not apply retroactively to agreements already concluded, unless permitted by law.
Additional or deviating agreements are only valid if they have been recorded in writing or on another durable medium and must not limit the statutory rights of consumers.
